Below we give a summary of bylaws regarding renovations.
The following clauses are extracted from the Pantai Hillpark 5 By-Laws document (2024 FINAL AGM APPROVED VERSION) and relate specifically to renovation activities:
SCHEDULE V – RULES AND REGULATIONS GOVERNING RENOVATION WORKS
1. A Proprietor shall deposit RM2,000 for major renovation or repair, and RM500 for minor renovation.
2. Major renovations include hammering, hacking, grinding, pounding, drilling, masonry wet works, piping, major electrical installations, and facade work.
3. Minor renovations involve drilling or hacking that can be completed within a day, and repairs involving movable items or appliances.
4. Major renovation requires explicit approval with full documentation. The management has 3 working days to review applications.
5. Unauthorized renovations or repairs will be stopped immediately and fined RM200.
6. Permitted work hours:
- Monday to Friday: 9am–5pm (noise-heavy works until 3pm)
- Saturday: 9am–1pm (noise-heavy works not allowed)
- Sunday & Public Holidays: Not allowed
7. Emergency works outside of permitted hours require justification for safety or service restoration.
8. Delivery teams must protect surfaces in lifts/common areas and clean up after unloading.
9. Renovation materials must be stored within the parcel unless approved otherwise; temporary use of common area is at owner's risk.
10. Proprietors must provide own roro bins for renovation debris. Proper surface protection and coverage after hours are required.
11. Management may conduct inspections during works and issue stop-work orders if needed. Management may rectify non-compliance at Proprietor's cost.
12. A final inspection will be conducted post-renovation. Deposits will be refunded net of any damage or cleaning costs.
13. All renovation works must comply with relevant authorities' requirements and obtain required approvals.
14. Structural hacking/modifications, breaking party walls, or removing fire-rated doors is strictly prohibited.
15. Proprietors must ensure renovation debris is removed daily. Management will clean and charge the cost if not done.
16. If a unit defect affects others/common areas, the owner has 14 days to act. Otherwise, Management will repair at their cost.
17. Facade modifications are limited to interior window grills, exterior door grills, and satellite/broadband installations, with prior approval.
18. No awnings or other projections through windows/doors are allowed. AC compressors and related items must be installed internally.
19. No visible signage, posters, or decorations from outside the unit are allowed.
These regulations ensure renovations are conducted safely, neatly, and without affecting neighbors or the common property.
Below we give a summary of bylaws regarding defaulters and car clamping.
1. Car Clamping Regulations
• Vehicles may be wheel-clamped or towed if parked incorrectly or in unauthorized areas. This includes parking more than one vehicle in a bay, overnight guest parking without approval, or occupying other units’ designated lots. (Clause 17.1, 17.6, 17.8, 17.12, 17.14)
• Wheel clamping removal fees: RM100 per car, RM50 per motorbike. Holding charges: RM30 per day. (Clause 17.2, 17.15; Schedule VI)
• Vehicles without proper stickers or access permits will be clamped. One motorcycle sticker per unit. (Clause 17.12, 17.13)
• Management Corporation is not liable for damage or loss from enforcement actions. (Clause 17.16)
• All related charges for towing and clamping are deemed contributions to the Management Fund. (Clause 17.15)
2. Defaulter Enforcement By-Laws
• Service charge and sinking fund payments are due by the 14th of each month. Late payments incur 10% annual interest. (Clause 6.2, 6.3)
• If arrears exceed RM1,000, the Management may:
- Deny vehicle and visitor entry
- Deny food delivery to unit
(Clause 6.5)
• Defaulters are publicly listed with name, unit, and outstanding dues on notice boards. (Clause 6.4)
• Water supply may be disrupted for non-payment and a RM20 restoration fee applies. (Clause 6.5, Schedule VI)
• All fines and penalties become part of the Management Fund. (Clause 6.3, 6.5, Schedule VI)
• Management Corporation reserves the right to seek legal recovery, and all associated legal costs shall be borne by the Proprietor. (Clause 6.5; Schedule VI)
