17-12-25 - NEW ADDITIONAL BYLAWS 2026!!!!! 

KEMAS KINI MO: Peraturan Tambahan Baharu yang Diluluskan bagi Tahun 2026
 

Dengan ini dimaklumkan bahawa dalam Mesyuarat Agung Tahunan (AGM) PHP5 ke-5, tiga (3) peraturan tambahan baharu telah diluluskan oleh para pemilik.


Peraturan yang memberi kesan operasi paling ketara adalah berkaitan dengan pengurusan pemilik tertunggak (defaulters).

Berkuat kuasa mulai tahun 2026, Pejabat Pengurusan akan melaksanakan tindakan terhadap pemilik tertunggak selaras dengan Akta Pengurusan Strata 2013.

Pada tahun 2025, satu ambang RM1,000 telah diperkenalkan bagi memberi kelonggaran pembayaran. Walau bagaimanapun, pengalaman menunjukkan bahawa pendekatan ini tidak berkesan, kerana ramai pemilik tertunggak membenarkan tunggakan mereka meningkat sehingga ke paras ambang tersebut. Keadaan ini telah menyebabkan peningkatan jumlah tunggakan keseluruhan kira-kira RM39,000.


Sehubungan itu, pendekatan ini akan ditamatkan mulai tahun 2026.

Di bawah peraturan tambahan yang baharu diluluskan, takrif pemilik tertunggak akan diselaraskan dengan Seksyen 27(2), Akta Pengurusan Strata 2013, iaitu:

Seseorang pemilik dianggap sebagai pemilik tertunggak sekiranya sebarang caj penyelenggaraan, sumbangan dana penyenggaraan (sinking fund), atau apa-apa caj lain tidak dibayar melebihi empat belas (14) hari daripada tarikh akhir pembayaran seperti yang dinyatakan dalam invois atau notis.

Dengan ini dimaklumkan bahawa, berkuat kuasa mulai tahun 2026, pihak Pengurusan akan mengambil tindakan terhadap mana-mana pemilik yang gagal menjelaskan bayaran tertunggak dalam tempoh 14 hari selepas invois yuran penyelenggaraan bulanan dikeluarkan.


Kerjasama semua pemilik dalam memastikan pembayaran dibuat tepat pada masanya amatlah dihargai, demi menyokong penyelenggaraan dan pengurusan PHP5 yang berterusan dan berkesan.

MO UPDATE: Newly Approved Additional By-Laws for 2026
 

Please be informed that at the 5th PHP5 Annual General Meeting, three (3) additional by-laws were approved by the owners.


The by-law with the most significant operational impact relates to the management of defaulters.
Effective from 2026 onwards, the Management Office will enforce defaulter actions in accordance with the Strata Management Act 2013.


In 2025, a RM1,000 threshold was applied to provide payment flexibility. However, experience has shown that this approach was counterproductive, as many defaulters accumulated outstanding amounts up to the threshold. This resulted in an increase of approximately RM39,000 in total outstanding arrears.


Accordingly, this approach will be discontinued in 2026.

Under the newly approved by-law, the definition of a defaulter will align with Section 27(2) of the Strata Management Act 2013, whereby:

A proprietor is considered a defaulter if any maintenance charges, sinking fund contributions, or other charges remain unpaid for more than fourteen (14) days from the due date stated in the invoice or notice.


Please take note that, effective 2026, Management will take enforcement action against any proprietor who fails to settle outstanding amounts within 14 days of the issuance of the monthly maintenance fee invoice.


Your cooperation in ensuring timely payment is appreciated, as it supports the continued maintenance and smooth operation of PHP5.

其中,对日常管理影响最大的一项,涉及 欠费业主(Defaulters)的管理与执法。
自 2026 年起,管理处将严格依据 2013 年分层管理法令(Strata Management Act 2013) 对欠费业主采取相应行动。


在 2025 年,管理处曾设定 RM1,000 的欠费门槛,以给予业主一定的付款便利。然而,实际执行结果显示,该做法产生了反效果,部分欠费业主将欠款累积至该门槛水平,导致整体欠费金额增加约 RM39,000。

因此,该 RM1,000 欠费门槛政策将 自 2026 年起正式取消。


根据新批准的附加附则,欠费业主的定义将与 《2013 年分层管理法令》第 27(2) 条款 保持一致,即:

如业主未能在发票或通知所列明的到期日后 十四(14)天内 缴清任何管理费、维修基金(Sinking Fund)或其他应付费用,该业主即被视为欠费业主。


敬请注意,自 2026 年起,凡未能在每月管理费发票发出后 14 天内 结清应付金额的业主,管理处将根据相关附则及法律规定采取相应的执法行动。


管理处感谢各位业主的理解与配合,及时缴付费用将有助于持续维持 PHP5 安全、清洁及良好维护的居住环境。

16-12-25 - CODE OF CONDUCT IN PHP5 Telegram Group 

MO UPDATE: TELEGRAM CODE OF CONDUCT REMINDER
 

During the recent 5th AGM, it was highlighted that a small number of participants have posted negative, rude, or inappropriate language in the MO PHP5 Telegram group. Such communication disrupts constructive engagement and undermines the positive, value-creating efforts being carried out for PHP5 by MO and MC team.


It was therefore stated during the AGM that repeated breaches of respectful conduct, after warning, result in removal from the Telegram group.


The Telegram group exists to enable constructive two-way communication between owners and the Management Office, with the purpose of understanding challenges, sharing factual information, and identifying practical improvements.


The Management Office welcomes all feedback that is shared respectfully and contributes toward maintaining a SAFE, CLEAN, and WELL-MAINTAINED living environment for all residents.

REVOCATION of Parking Bay

Please be informed that proprietors with outstanding / arrears in service charges (maintenance fee) exceeding RM 1000.00, the unit's allotted parking bay will be revoked. The vehicle of Units with outstanding exceeding RM 1000.00 will not be allowed to enter the premises until the full settlement is made, this is as stipulated in the house rules.

This will be implemented effective immediately (this week).
Please see to it that payments are made without any delay.
The above is applicable to Units which are tenanted too, meaning your tenant/s would be deprived off a parking bay.

Dimaklumkan bahawa pemilik unit yang mempunyai tunggakan caj perkhidmatan (yuran penyelenggaraan) melebihi RM1,000.00, petak parkir yang diperuntukkan kepada unit tersebut akan dibatalkan. Kenderaan bagi unit yang mempunyai tunggakan melebihi RM1,000.00 juga tidak akan dibenarkan masuk ke premis sehingga bayaran penuh dijelaskan, selaras dengan peraturan rumah yang telah ditetapkan.

Perlaksanaan ini akan berkuat kuasa serta-merta (minggu ini).
Oleh itu, pihak tuan/puan diminta untuk membuat bayaran tanpa sebarang kelewatan.
Perkara ini turut terpakai untuk unit yang disewakan – bermaksud penyewa unit juga tidak akan dapat menggunakan petak parkir.

14-01-25 - Defaulter Protocols 2025

Dear Residents,
 

Vehicle Stickers and Defaulters
In a previous notice, we informed residents that defaulters owing over RM 1,000 in service charges would not be eligible to receive vehicle stickers. In this notice we update you with all the defaulter protocols for Pantai Hillpark 5:


How to Collect a Vehicle Sticker:
Every owner is eligible to collect a vehicle sticker if their outstanding service charge fees do not exceed RM 1,000.


What Happens If I Owe More Than RM 1,000?

•Owners with outstanding over RM 1,000 will not be able to collect vehicle stickers unless they pay up until their maximum outstanding is RM 1K only.

•Vehicles belonging to defaulters must be parked outside Pantai Hillpark 5.

•The parking lots within Pantai Hillpark 5 are owned by the management, and defaulters will no longer be permitted to park in these lots starting 3rd March 2025. Defaulter installment payment plans will no longer be offered.


No vehicle Stickers = No Entry
As per 3rd March 2025 vehicles (cars and motorbikes) will not be able to enter PHP5 anymore and need park outside the compound!

Stop Food Delivery Protocols for Defaulters:
Effective 3rd March 2025, food deliveries will no longer be allowed for defaulters.
Defaulters can collect their food at the guardhouse.


Aiming for a Financially Healthy Pantai Hillpark 5
With these new defaulter protocols, the PHP5 the Management aims to improve the financial standing
of the property in 2025, enabling us to maintain the property at the highest standards for all residents.
